Suit brought on by government employees union over the data breach, claiming violation of Aviation and Transportation Security Act, and violation of the Privacy Act. ATSA claim dismissed March 31st, 2008. Sanctions were later imposed on the plaintiffs for failing to preserve documents relevant to the case.

In may, 2009, the judge denied certification of the class on the grounds that it sought only monetary damages, and not restitution. While the case is still open, it is all but dead as a class action lawsuit.
